How do Clarksville's weather and ground affect a fence?

Clarksville gets about 53.5 inches of precipitation a year and only about 7.2 inches of snow, so the main enemy of a fence here is water, not snow load. Posts that sit in damp soil rot at the ground line, and saturated soil lets posts lean under wind. Winters are usually mild, with an average January low near 28 degrees, but the record low is 20 below zero, and freeze-thaw cycles can still loosen shallow posts. Storms are the other factor: an F3 tornado devastated downtown in 1999, and an EF3 tornado struck north Clarksville in December 2023. Ask any contractor how deep they set posts, how they shape the footing to shed water, and how they size posts and gates for wind.

Do I need a permit for a fence?

Outside Clarksville city limits, Montgomery County Building and Codes says a building permit isn't required to build a fence and there are no fence setbacks. The fence still must not encroach on a neighbor's property, a drainage or utility easement, or the public right of way. Inside city limits, the county directs people to the City of Clarksville's Building and Codes office, and zoning questions go to the Clarksville-Montgomery County Regional Planning Commission. Clarksville is the county's only incorporated city, so those are the two sets of rules to know. If you live in Oak Grove, Kentucky, check with that city instead.

What about a fence around a pool?

Montgomery County requires a pool permit for all in-ground and above-ground pools, and a barrier permit must be pulled by the property owner before the pool permit is issued. Pool barriers have specific height, opening and gate requirements, so tell your contractor the fence is a pool barrier at the start, and ask the permit office what inspection is needed.

Who has to call 811?

Anyone who digs. Tennessee 811 is free and asks for at least three working days' notice before you start. It notifies utility owners, who send locators to mark their lines; Tennessee 811 doesn't mark lines itself. Tickets are valid for 15 calendar days after the requested start date, so a project that slips may need a new ticket. Private lines, such as a feed to a shop or a water line to a barn, aren't marked by the utilities, and 811 can't send a private locator for you; hire one if you have lines like that.

Does a fence contractor need a license in Tennessee?

The Tennessee Board for Licensing Contractors requires a contractor license before bidding or contracting on a project of $25,000 or more, counting materials and labor, and contractors must bid and contract in the exact name on the license. Tennessee also has a separate home improvement license for jobs between $3,000 and $25,000, but it applies only in counties that adopted it, and Montgomery County isn't on the state's list. For smaller jobs, ask for proof of general liability insurance and, if the contractor has employees, workers' compensation coverage.

What should I know about sinkholes?

Montgomery County sits in a well-developed karst region, and the county's stormwater department says sinkholes are a common feature here. They form as water dissolves limestone and can grow or reopen after being filled. The county recommends consulting a civil engineer or geotechnical professional before altering a sinkhole, fencing livestock away from them, and keeping chemicals and dumping out of them. Its stormwater rules call for a 60-foot undisturbed buffer around sinkhole throats, cave entrances and Class V injection wells. Plan fence lines around them rather than through them.

What about HOA covenants?

Many subdivisions around Clarksville have recorded covenants that set fence height, material, style and color, and some require written approval before you build. Covenants can be stricter than zoning. Get the current rules and approval form before collecting quotes, so every contractor bids on the same fence.

Questions to ask a fence contractor

  • Do you carry liability insurance and workers' comp? If the job is $25,000 or more, what's your Tennessee license number?
  • How deep will you set posts, in what, and how will the footing shed water?
  • Who files the 811 request, and who checks zoning, HOA rules and any pool barrier permit?
  • How will you handle rock, slopes and any sinkholes on the line?
  • What does your warranty cover, and for how long?
